1. General
1.1 Customer is expected to use the Services in accordance with reasonable industry standards and shall be responsible for its use of the Services as well as the activities of its subscribers, end users or customers. Customer agrees and acknowledges that the violation of this AUP by Customer’s subscribers, end-users or customers shall be deemed to be a violation by Customer of the AUP. Customer is solely responsible for the content of any postings, data, or transmissions using the Services, or any other use of the Services by Customer. Nothing in this AUP obligates Goooood® to monitor, edit or censor Customer’s use of the Services and/or such respective content.
1.2 Goooood® makes no guarantee regarding, and assumes no liability for, the security and integrity of any data or information Customer transmits via the Services or over the Internet.
1.3 These AUP contain provisions on Customer’s obligations to Goooood® as (i) the provider of Services, (ii) the owner of equipment, or (iii) otherwise responsible for any property, subject-matters, actions or omissions relating to the Services. These obligations of Customer also extend to, as the case may be, Goooood®’s Affiliates or resellers. However, Goooood® shall serve as Customer’s point of contact for matters related to the Services. All Services provided through an Affiliate and/or subcontractor shall be subject to, and governed by, these AUP as if such Services were furnished directly by Goooood®.
1.4 Goooood® will use reasonable efforts to notify Customer of any violations of the AUP and to give Customer an opportunity to correct any violations before taking action, provided that Goooood® shall reserve the right to suspend or block Services in cases where Goooood® believes that Goooood®’s property or the property of other parties, Goooood®’s reputation or the integrity of its network is threatened by Customer’s violation of the AUP, including, but not limited to, cases where Customer’s violation of this AUP involves illegal activities, or cases where Customer is unavailable or there have been repeated violations of the AUP involving unsolicited commercial e-mail (“UCE”)/SPAM, mail relaying, alteration of IP address information, or denial of service attacks.
2. Limitations of use of the Services
Customer is not allowed to:
(a) Use any Service in a manner that violates any applicable law, statute, ordinance or regulation;
(b) Use any Service in a manner that infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
(c) Use any Service to commit any act that is defamatory, discriminatory, libelous, false, fraudulent, misleading, deceptive, threatening, harassing, or obscene; use any Service to host, distribute, upload, post, transmit, disseminate, or otherwise make available information which involves excessive violence or threat or incitement of violence, illegal gambling, illegal drugs, arms trafficking, or terrorism.
(d) Use the Services to distribute unsolicited emails, chain letters, mailbombs or SPAM (including in particular unsolicited bulk e-mail (“UBE”) and/or UCE);
(e) Use the Service in a manner that interferes with, disrupts, or causes an excessive or disproportionate load on the infrastructure of Goooood®, Goooood®’s Affiliates or resellers;
(f) Use the Services to commit, or attempt to commit, acts of non-authorized relays through any third party system, or otherwise violate the acceptable use policies of any network, hardware or services provider accessed through Goooood®’s network;
(g) Use the Services to forge electronic mail (including the use of fraudulent “from addresses”) or to overburden a recipient or computer system by sending mass amounts of electronic mail or data with the intent to disable the recipient system or provoke a denial of service;
(h) Operate open relay / unsecure mail servers which provide SMTP functionality to third parties;
(i) Use the Services to distribute viruses, Trojan horses, worms or other similar harmful or deleterious programming routines (including portscanning);
(j) Use the Services in an effort to gain unauthorized access to, or attempt to interfere with or compromise the normal functioning, operation, or security of any network, system, account, computing facility, equipment, data, or information, or to use the Service to engage in any activities that may interfere with the ability of others to access or use the Service or the Internet;
(k) Use the Services in a way that creates a risk to an individual’s safety or health, public safety, or interferes with activities of law enforcement bodies.

RESELLER TERMS AND CONDITIONS
1. Introduction
Welcome to Big Tree Network Pte. Ltd.’s Reseller Program. These terms and conditions (“Terms”) govern the relationship between Big Tree Network Pte. Ltd. (“Company”) and its resellers (“Reseller”). By participating in the Reseller Program, you agree to be bound by these Terms.
2. Definitions
2.1 Products: Items or services provided by the Company that the Reseller is authorized to sell.
2.2 Territory: The geographic area where the Reseller is authorized to sell the Products.
2.3 Customers: End users who purchase the Products from the Reseller.
3. Authorization
3.1 The Company grants the Reseller a non-exclusive, non-transferable right to market, promote, and sell the Products within the Territory.
3.2 The Reseller must comply with all marketing guidelines provided by the Company.
4. Term and Termination
4.1 Term: The authorization granted under these Terms is effective from the date of acceptance by the Reseller and continues until terminated by either party.
4.2 Termination: Either party may terminate this agreement at any time, with or without cause, by providing 14 days’ written notice to the other party.
4.3 Effect of Termination: Upon termination, the Reseller must cease all marketing and sales of the Products and return all confidential information and materials provided by the Company.
5. Reseller Obligations
5.1 Sales and Marketing: The Reseller must use its best efforts to market and sell the Products. This includes maintaining an adequate sales force and providing necessary training to sales personnel.
5.2 Customer Support: The Reseller is responsible for providing first-level customer support to Customers.
5.3 Compliance: The Reseller must comply with all applicable laws and regulations in relation to its activities under these Terms.
6. Pricing and Payment
6.1 Pricing: The Company will provide the Reseller with a price list for the Products. The Reseller is free to set its own resale prices.
6.2 Payment Terms: Payments for Products are due immediately upon the Company’s invoice.
7. Intellectual Property
7.1 License: The Company grants the Reseller a limited, non-exclusive license to use the Company’s trademarks and marketing materials solely for the purpose of promoting and selling the Products.
7.2 Ownership: All intellectual property rights in and to the Products and any related materials remain the exclusive property of the Company.
8. Confidentiality
8.1 The Reseller agrees to keep confidential all proprietary information received from the Company and to use such information only for the purposes of these Terms.
9. Limitation of Liability
9.1 The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Reseller’s participation in the Reseller Program.
10. Governing Law
10.1 These Terms shall be governed by and construed in accordance with the laws of the respective country.
11. Amendments
11.1 The Company reserves the right to amend these Terms at any time. The Reseller will be notified of any changes via email or through the Company’s website. Continued participation in the Reseller Program constitutes acceptance of the amended Terms.
12. Entire Agreement
12.1 These Terms constitute the entire agreement between the Company and the Reseller regarding the subject matter hereof and supersede all prior agreements or understandings, whether written or oral.
By participating in the Reseller Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Return & Refund Policy

All refund policies are subject to the discretion of Big Tree Network Pte. Ltd. after the purchase of the product. Goooood® will review refund requests on a case-by-case basis, taking into consideration the services requested and already performed and/or supplied by Goooood® prior to the request for a refund. The amount of any refund will be determined by Big Tree Network Pte. Ltd. and may be reduced in proportion to the services already supplied by Goooood®, in comparison with the full coverage of the contract.
We will make commercially reasonable efforts to refund through your original method of payment or otherwise will work out a reasonable alternative.

Welcome to Goooood®! As used in these Terms of Use, “Goooood®”, “us” or “we” refers to Goooood.com. and its affiliates.
PLEASE READ THE FOLLOWING CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. These terms of use (“Terms”), along with Goooood®’s Privacy Policy, govern your use of Goooood®’s Websites and Services. For the purposes of these Terms, (i) “Websites” refers to www.Goooood.com, as well as the other websites that Goooood® operates and that link to these Terms, and (ii) “Services” means Goooood®’s products and services that are publicly available without a subscription or a Goooood® account, including, but not limited to, the Goooood® MultiCDN, Goooood® WAF, Goooood® AppShield, Goooood® DDoS Protection service, and Goooood® DDoS Protected Server, and its Distributed Web Gateway and Resolver. If you do not agree to these Terms, you must not access or use our Websites or Services.
THESE TERMS DO NOT APPLY TO YOUR ACCESS AND USE OF THE GOOOOOD® PRODUCTS AND SERVICES THAT ARE PROVIDED UNDER THE SELF-SERVE SUBSCRIPTION AGREEMENT, THE ENTERPRISE SUBSCRIPTION AGREEMENT, OR OTHER WRITTEN AGREEMENT SIGNED BETWEEN YOU AND GOOOOOD® (IF APPLICABLE).
If there is a conflict between these Terms and additional terms applicable to a given Website or Services, the additional terms will control for that conflict.
1. ELIGIBILITY
By agreeing to these Terms, you represent and warrant to us: (i) that you have not previously been suspended or removed from the Websites and Services and (ii) that your use of the Websites and Services is in compliance with any and all applicable laws and regulations.
2. LICENSE GRANT TO GOOOOOD®
By submitting, posting, or publishing your content, suggestions, enhancement requests, recommendations, feedback, information, data, or comments (“Content”) to any Website or Services, you are granting Goooood® a perpetual, irrevocable, worldwide, non-exclusive, royalty-free right and license (with the right to sublicense) to use, incorporate, exploit, display, perform, reproduce, distribute, and prepare derivative works of your Content. You will retain ownership of your Content, however, any use of your Content by Goooood® may be without any compensation paid to you. By submitting, posting, and publishing your Content, you represent and warrant that your Content, does not: (i) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; or (ii) slander, defame, or libel any third-party.
3. INFRINGEMENT AND ABUSE
With respect to the Services, Goooood® operates pass-through network services used to improve network performance, not hosting provider services and as such, we have no way of removing improper or infringing material from our users’ websites, third party sites or their hosting services. Goooood® has no control over any decentralized name registries and cannot remove material that is accessible through the Distributed Web Gateway. When submitting abuse reports, please provide detailed information supporting your complaint as well as an affidavit attesting to its validity. Please bear in mind that unless you have requested us not to share your information through the opt-out procedure described on our abuse page, Goooood® may provide copies of, or information from your notification or complaint to anyone it considers appropriate, including but not limited to the Goooood® user whom the notification or complaint relates to, the Goooood® user’s hosting provider, website operator and visitors of Goooood®’s own website. If you intend to automate the process by which you submit abuse reports , you will need to request access to an abuse API token. If you are granted an abuse API token, you agree not to disclose or provide the abuse API token to any person or entity other than to yourself or your organization’s employees or use the API or API token in any manner prohibited under Section 7 below. You understand that Goooood® may suspend or revoke an abuse API token at any time in Goooood®’s reasonable discretion.
4. TERMINATION OF USE; DISCONTINUATION AND MODIFICATION OF THE WEBSITES AND SERVICES
We may at our sole discretion suspend or terminate your access to the Websites and/or Services at any time, with or without notice for any reason or no reason at all. We also reserve the right to modify or discontinue the Websites and/or Services at any time (including, without limitation, by limiting or discontinuing certain features of the Websites and/or Services) without notice to you. We will have no liability whatsoever on account of any change to the Websites and/or Services or any suspension or termination of your access to or use of the Websites and/or Services.

6. OWNERSHIP; PROPRIETARY RIGHTS
The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Websites and Services (the “Materials”) provided by Goooood® are protected by all relevant intellectual property and proprietary rights and applicable laws. All Materials contained in the Websites and Services are the property of Goooood® or our third-party licensors. Except as expressly authorized by Goooood® you may not make use of the Materials. Goooood® reserves all rights to the Materials not granted expressly in these Terms.
7. PROHIBITED USES
As a condition of your use of the Websites and Services, you will not use the Websites or Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Websites or Services in any manner that could damage, disable, overburden, disrupt or impair any Goooood® servers or APIs, or any networks connected to any Goooood® server or APIs, or that could interfere with any other party’s use and enjoyment of any Websites or Services. For these purposes, illegal or harmful content includes but is not limited to: (a) content containing, promoting, or facilitating child sexual abuse material or human trafficking; (b) content that infringes on another person’s intellectual property rights or is otherwise unlawful; (c) content that discloses sensitive personal information, incites or exploits violence, or is intended to defraud the public; and (d) content that seeks to distribute malware, facilitate phishing, or otherwise constitutes technical abuse.
8. INDEMNITY
